1. Your Account

However, we do not warrant that service descriptions, predictions, or any other content on this site is error-free. All predictions and analyses are provided “as is” and are not guaranteed to be accurate, complete, or current.

3. Applicable Law

By visiting the site, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern this Terms and Conditions of Use agreement. 5. Ordering and Registration

Our registration format requests certain contact information from our users. We collect information that is personally identifiable through the registration and purchasing process when processing your order. When a user completes an order, the format will require personally identifiable information, including: contact information (examples include name, email address), unique identifiers (examples include payment card information processed through our payment provider), and demographic information (examples include zip code, telephone area code).

Our policy is to refrain from selling, leasing, or otherwise transferring your personally identifiable information. We only use information you submit to deliver information, products, or services specifically requested by you, or to cooperate with law enforcement officials in the investigation of alleged unlawful activities of our customers.

6. Billing Details

Your payment card will only be charged the amount shown at checkout. The charge will be shown on your statement as Earl Knows Ball or Nexmuse LLC. All payments are processed by our third-party payment provider, Stripe.

7. Premium Membership

Premium Membership subscriptions will be billed at the beginning of the billing cycle chosen (monthly or yearly, as applicable). Where a trial period is offered, your payment card will be charged at the end of the trial period unless you cancel before the trial ends.

You may cancel your membership at any time. You are responsible for the full subscription fee in the billing cycle in which you cancel. Once your account has been billed, all sales are final and there will be no refunds, except as required by applicable law.

You can cancel your membership by logging into your account and managing your subscription. Upon cancellation, you will no longer be a premium member and will lose access to all premium membership benefits at the end of the current billing cycle.

8. Refunds

Subscription fees paid for Premium Membership are non-refundable, except as required by applicable law. If you believe you have been charged in error, please contact us using the information below.

9. User Content and Copyright

By submitting, posting, or uploading any content to the Service, you warrant that you have the right to submit this material. Nexmuse, LLC cannot accept responsibility for copyright violations on content submitted by users. We ask our users to seek copyright permissions for the work they submit. If we believe that any content submitted contains illegal content or any content that infringes intellectual property rights, or content that violates the law, then we may remove such content and/or contact the appropriate legal authorities.

YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NEXMUSE, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

NEXMUSE, LLC MAKES NO WARRANTY AS TO THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THIS SERVICE.

YOU SPECIFICALLY ACKNOWLEDGE THAT NEXMUSE, LLC IS NOT LIABLE FOR YOUR DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT, OR SUCH CONDUCT BY THIRD PARTIES, AND YOU EXPRESSLY ASSUME ALL RISKS AND RESPONSIBILITY FOR DAMAGES AND LOSSES ARISING FROM SUCH CONDUCT.
